[ aside from that it is always easy to raise abstract claims, but
  can be hard to substantiate them ]

if and only if it has multiple, separately developed from only the
spec, interoperable implementations.  there are a fair number of
critical protocols where one could not really do an implementation
from the spec, and it required 'inside knowledge' and this was
used, let's be kind and say unintentionally, to raise a bar against
new market entries.
