Indeed they do.  Of course, if a Democratic President is elected and
the Senate remains Republican, there is nothing to require the Senate
to consider any nominations by that President either.  The number of
judgeships is specified by an ordinary law (it is not in the Constitution
and has varied from time to time), but there is nothing to say that all
judgeships must be filled at any given time.
