No.  He can't know that part of the list history, and
he didn't post the article quoting an "unposted" mail.

I think the "unposted" mail had a To: list (or a Cc:),
it's easy to confuse this in the inbound, one Re:All
and the quote shows up on the list.

Besides the PR doesn't forbid to quote or to forward
unposted mails, you've done that some months ago with
a registration request, and that was perfectly okay.

P.S. for those who don't know it:  A "PR" is an IETF
last called "posting rights" action specified in a
memo styling itself as "BCP 83" or "RFC 3683".
